robonova.ai is owned and operated by robonova Technologies, Inc. ("robonova," "we," "us," or "our"). We reserve the right to modify these Terms at any time. If we make changes, we will provide notice by posting the updated Terms on our website and updating the "Last Updated" date. Your continued use of the Services after any such changes constitutes your acceptance of the new Terms.

2. Services Description

robonova.ai provides AI-powered lead generation and social promotion services designed to help businesses find, qualify, and connect with potential customers. Our Services include, but are not limited to:

  • Identifying and qualifying leads based on specified criteria
  • Promoting client businesses across social networks
  • Providing verified contact information for interested leads
  • Offering analytics and reporting on lead generation campaigns

We reserve the right to modify, suspend, or discontinue any part of the Services at any time without notice or liability.

3. Account Registration and Security

To access certain features of the Services, you may need to register for an account. When you register, you agree to provide accurate, current, and complete information about yourself and your business. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

We reserve the right to suspend or terminate your account if any information provided during registration or thereafter proves to be inaccurate, false, or misleading, or if you fail to comply with these Terms.

4. Fees and Payment

robonova.ai operates on a pay-per-interested-lead pricing model. Fees vary based on the advertising channel used to generate the lead, ranging from $40 to $60 per interested lead. Detailed pricing information is available on our Pricing page.

You agree to pay all fees associated with your use of the Services. All fees are non-refundable unless expressly stated otherwise or required by law. We reserve the right to change our fees at any time, with notice provided on our website.

If you dispute any charges, you must notify us in writing within thirty (30) days of the date of the charge. If you fail to dispute a charge within this period, you waive any dispute of such charge.

5. Lead Quality and Verification

While we make every effort to provide high-quality, verified leads, we cannot guarantee that every lead will result in a business opportunity or sale. We define an "interested" lead as someone who has taken specific actions that demonstrate genuine intent to learn more about your business, as outlined in our documentation.

If you believe a lead does not meet our quality standards, you must notify us within seven (7) days of receiving the lead. We will review your claim and, at our discretion, may provide a credit for future leads if we determine the lead did not meet our standards.

6. User Conduct

You agree not to use the Services to:

  • Violate any applicable law, regulation, or third-party rights
  • Engage in false, deceptive, or misleading practices
  • Collect or harvest personal information from leads without proper consent
  • Use leads for purposes other than legitimate business contact
  • Attempt to gain unauthorized access to the Services or other users' accounts
  • Interfere with the proper functioning of the Services
  • Engage in any activity that could harm robonova.ai's reputation or business

We reserve the right to investigate and take appropriate action against any user who violates these provisions, including suspending or terminating accounts and reporting illegal activity to law enforcement authorities.

7. Intellectual Property Rights

All content, features, and functionality of the Services, including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, data compilations, software, and the compilation thereof, are owned by robonova.ai, our licensors, or other providers of such material and are protected by copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

These Terms do not grant you any right, title, or interest in the Services or our content. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any material from our Services without our prior written consent.

8. Privacy and Data Protection

Our Privacy Policy, available at Privacy Policy, describes how we collect, use, and share information about you and the leads we provide. By using the Services, you consent to our collection, use, and sharing of information as described in the Privacy Policy.

You agree to comply with all applicable data protection and privacy laws when using leads provided through our Services. This includes obtaining any necessary consents for contacting leads and implementing appropriate security measures to protect lead information.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, robonova.AI AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICES; (III) ANY CONTENT OBTAINED FROM THE SERVICES; AND (IV) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE AMOUNT PAID BY YOU TO robonova.AI DURING THE TWELVE (12) MONTH PERIOD PRECEDING THE EVENT GIVING RISE TO THE LIABILITY.

10. Indemnification

You agree to defend, indemnify, and hold harmless robonova.ai and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from: (i) your use of and access to the Services; (ii) your violation of any term of these Terms; (iii) your violation of any third-party right, including without limitation any copyright, property, or privacy right; or (iv) any claim that your use of the Services caused damage to a third party.

11. Termination

We may terminate or suspend your access to the Services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the Services will immediately cease.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any dispute arising from or relating to these Terms or the Services shall be resolved exclusively in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of such courts.

Any cause of action you may have with respect to the Services must be commenced within one (1) year after the cause of action accrues, or such cause of action shall be permanently barred.

13. Miscellaneous

These Terms constitute the entire agreement between you and robonova.ai regarding the Services and supersede all prior and contemporaneous agreements, proposals, or representations, written or oral, concerning the subject matter.

If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced to the fullest extent under law.

Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision.

We may assign our rights and obligations under these Terms, in whole or in part, to any party at any time without notice to you. You may not assign any of your rights or obligations under these Terms without our prior written consent.
